THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO CIVIL REVISION PETITION No.3329 of 2015 ORDER:

Petitioners herein are plaintiffs in O.S.No.194 of 2012 on the file of Junior Civil Judge, Hindupur. The said suit was filed for permanent injunction restraining the respondents herein from interfering with the possession of the petitioners. The petitioners filed I.A.No.772 of 2012 and the same was disposed of on 05.10.2012 by the learned Junior Civil Judge, Hindupur by directing both parties to maintain status quo till the disposal of the suit. Challenging the said order, the petitioners herein preferred C.M.A.No.01 of 2013 and the same was dismissed by order, dated 09.12.2014. Challenging the same, the present revision petition is filed.

In view of concurrent finding of fact by the learned Junior Civil Judge as well as learned Senior Civil Judge, Hindupur, this Court is not inclined to interfere with the said finding, which is a tentative finding. Since the present proceedings arise out of the suit for permanent injunction, without expressing any opinion on merits of the case, while dismissing the present revision petition, the learned Junior Civil Judge, Hindupur is directed to dispose of O.S.No.194 of 2012 on his file, as expeditiously as possible, but not later than 30.06.2016 by giving due opportunity to both the parties uninfluenced the observations made in the Interlocutory Applications. There shall be no order as to costs.
