THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.739 of 2024 ORDER:
This Criminal Petition is filed under Section 438 of Cr.P.C. by petitioners/accused Nos.1 to 3 seeking anticipatory bail in the event of their arrest in connection with F.I.R No.03 of 2024 on the file of the Palakeedu Police Station, Suryapet, registered for the offences punishable under Sections 447, 506 and 307 read with 34 of Indian Penal Code.

Heard learned counsel for the petitioners, learned Additional Public Prosecutor for the respondent-State and perused the record. 3.
On the basis of the private complaint filed by the de facto complainant, the police registered the case on 06.01.2024. It is alleged in the complaint that these petitioners/accused Nos.1 and 2 trespassed into the fields of the de facto complainant and threatened to kill them and also attempted to kill the complainant. The said incident happened on 22.11.2023. Thereafter, according to the complaint, the de facto complainant approached the police on 27.12.2023 and 29.12.2023, however, there was no response, for which a private complaint was filed.

As seen from the complaint, no injuries were received and it is alleged that petitioners/accused nos.1 and 2 threatened with axe and revolver and there is no specific allegations made against the accused No.3. In the said circumstances, this Court deems it appropriate to grant relief of anticipatory bail to the petitioners, subject to the following conditions:
1) The petitioners/accused Nos.1 to 3 are directed to surrender before the Station House Officer, PS, Palakeedu, Suryapet District, on or before 31.01.2024. Upon such surrender, the said Station House Officer shall release the petitioners/accused Nos.1 to 3 on bail, on their executing personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each with two sureties for a like sum each to his satisfaction.
2) On such release, the petitioners/accused Nos.1 to 3 shall appear before the concerned Station House Officer on every Monday at 10am for a period of four (04) weeks and thereafter, as and when required, for the purpose of investigation.
3) The petitioners/accused Nos.1 to 3 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
