THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.1443 of 2016 ORDER:

1. This Criminal Revision Case is filed by the petitioner-complainant aggrieved by the endorsement dated 24.3.2015 passed in C.F.R.No.1405 of 2015 in M.P.No.551 of 2015 in DVC No.8 of 2015 by the IX Metropolitan Magistrate, Miyapur.

2. When the petitioner filed a rejoinder in the above DVC, the learned Magistrate returned the same with the following endorsement: "How the rejoinder is maintainable at the stage of arguments. Hence, may be ordered to return."

3. Heard and perused the material available on record.

4. Considering the facts and circumstances of the case, this Court is of the view that once such an endorsement was made by the Court below, it is the duty of the petitioner to inform the Court below as to how the said rejoinder is maintainable by way of filing a memo. Therefore, the petitioner is directed to explain before the Court below as to the maintainability of such rejoinder. On such memo being filed, the Court below is directed to decide the issue in accordance with law. If the petitioner is aggrieved by the order that would passed on the memo filed him, he is at liberty to approach this Court.

5. Accordingly, the Criminal Revision Case is disposed of. Consequently, the miscellaneous petitions pending, if any, shall stand closed.
