THE HON'BLE SRI JUSTICE A.VENKATESHWARA REDDY CIVIL REVISION PETITION No.2503 of 2009 ORDER:

Heard learned Government Pleader for Arbitration and Sri.D.Srinivas, Advocate on behalf of the respondents. Learned Government Pleader for Arbitration submitted that though they are entitled to deduct Income Tax as mentioned in the calculation sheet, they have paid that amount also. 2.

At this stage, learned counsel for the respondents submitted that the learned Judge of the trial Court is right in holding that the Land Acquisition Officer/Government is not entitled to deduct the Income Tax, however, on the day of the order, the Decree Holders have received the entire amount towards their claim in E.P.No.10 of 2000 in O.P.No.41 of 1981. 3.

Therefore, while recording the submissions made on either side, since the respondents/decree holders are not claiming any amount and the learned Government Pleader for Arbitration is also ready for closing the matter, while recording the above submissions, this Civil Revision Petition is closed. The Full Satisfaction Memo of the respondents/decree holders as submitted by the learned counsel for the respondent orally across the Bench is recorded.

Miscellaneous applications, if any pending, shall stands closed. In the circumstances of the case, there shall be no order as to the costs.
