THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION NO.1637 OF 2017 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C to enlarge the petitioners/A.1 and A.2 on bail in the event of their arrest in connection with Crime No.640 of 2016 of Panjagutta Police Station, Hyderabad, registered for the offence punishable under Section 3 (1) (x) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act.

After arguing the matter for a while, learned counsel for the petitioners requested the Court to permit the petitioners to surrender before the Special Judge for Trial of offences under Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act and file an application under Section 439 Cr.P.C. for grant of bail and on such surrender, the learned Special Judge may be directed to decide the application on the same day. He also brought to the notice of this Court that the 2nd petitioner is suffering from chronic kidney disease and undergoing regular dialysis. In support of his contention, he also filed doctor certificate to that effect.

Acceding to the request of learned counsel for the petitioners, without touching the merits of the case, I deem it appropriate to permit the petitioners to surrender before the Special Judge for Trial of cases under Scheduled Castes and the Scheduled Tribes (POA) Act and on such surrender, the learned Special Judge is requested to decide the application for bail, if any, filed on the same day, after serving notice on the learned Public Prosecutor.
