THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION NO.15136 OF 2016 ORDER:

This criminal petition is filed under Section 482 of Cr.P.C to quash the proceedings in C.C.No.100 of 2016 on the file of the Nampally Police Station, Hyderabad.

The 2nd respondent filed complaint against the petitioner for the offences punishable under Sections 420, 406 & 506 of IPC and the same was referred to the Station House Officer, Nampally Police Station, Hyderabad under Section 156(3) of Cr.P.C for investigation. Thereupon, the Station House Officer, Nampally registered F.I.R No.100 of 2016 on 25.04.2016 for the offences punishable under Sections 420, 406 & 506 of IPC.

At this stage, learned Public Prosecutor for the State of Telangana reported that the police referred the complaint as civil in nature and therefore, no further proceedings are pending for investigation to proceed against the petitioner. In view of the submission made by the learned Public Prosecutor for the State of Telangana that as on today no proceedings are pending in F.I.R No.100 of 2016, in view of referring the matter as civil in nature, no proceedings need to be quashed. Therefore, recording the submission made by the learned Public Prosecutor for the State of Telangana, the criminal petition is dismissed as infructuous.
