HON'BLE SRI JUSTICE G. SHYAM PRASAD M.A.C.M.A. No. 814 of 2010 JUDGMENT:

On previous two occasions, the learned counsel for the appellant was not present. There was no representation on behalf of the appellant. The matter was posted under the caption 'for dismissal.' Even today, the learned counsel for the appellant is not present. The learned counsel for the respondents submits that the Tribunal has passed the Award on consideration of the evidence on record and it does not require any interference. The Insurance Company has already deposited the compensation amount and it was withdrawn by the claimant.

Considering the facts and circumstances of this appeal, that the appellant is not prosecuting this appeal, the appeal is dismissed. There shall be no order as to costs.

As a sequel, miscellaneous petitions, if any, pending in this appeal shall stand closed.
