THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.37142 of 2014 O R D E R:

This writ petition, filed under Article 226 of the Constitution of India, calls in question the order passed by the Registrar, Jawaharlal Nehru Technological University, Hyderabad vide proceedings No.C3/7014/201314(Vol-V) (1), dated 10.10.2014.

2. Heard the learned counsel for the petitioner as also the learned Standing Counsel for the respondent and perused the material available.

3. Petitioner is a Professor in Water Resources & Director, School of Continuing & Distance Education in the respondent University. By virtue of the impugned order dated 10.10.2014, the first respondent posted the third respondent as Director In-charge of Institute of Science and Technology. The said order is under challenge in this writ petition.

According to the petitioner, the posting of the third respondent in the said post is contrary to law and guidelines issued by the University and the third respondent does not fulfil the eligibility criteria prescribed in the guidelines. It is the further grievance of the petitioner herein that despite representation dated 19.11.2014 submitted by the petitioner, no action has been taken by the first respondent in the direction of redressing the grievance of the petitioner.

Though a counter affidavit is filed by the third respondent resisting the writ petition, in the absence of any counter by the respondent university and as the representation submitted by the petitioner is pending consideration, this Court does not propose to go into the merits of the matter. But, this Court deems it appropriate to dispose of the writ petition with a direction to the first respondent to pass appropriate orders on the representation said to have been submitted by the petitioner in accordance with law by fixing some time frame.

For the aforesaid reasons, writ petition is disposed of, without expressing any opinion on the merits of the case and the entitlement of the parties, directing the first respondent to pass appropriate orders on the representation dated 19.11.2014 said to have been submitted by the petitioner, within a period of two months in accordance with law, after giving notice and opportunity to all the stake holders including the petitioner and the third respondent herein.
