HONOURABLE SRI JUSTICE S.V.BHATT WRIT PETITION No. 9745 of 2015 ORDER:

The petitioner prays for Mandamus declaring the action of third respondent in refusing to receive, register and release the document alleged to have been presented by the petitioner in respect of house property to an extent of 341 square yards in R.S.No. 458/16A of Vatluru village and Gram Panchayat,

Pedapadu Mandal, West Godavari District as illegal, arbitrary and without jurisdiction.

This Court, through order dated 06.03.2014 in Writ Petition No. 1339 of 2014 and batch, has considered legality of objection in refusing to register on the ground that the petitioner land is 'Gramakantam' and held that occupied 'Gramakantam' cannot be claimed as property belonging to Government and on such presumptuous approach include the property in the prohibited list. For the reasons recorded in Writ Petition No. 1339 of 2014 and batch, the Writ Petition is ordered.

Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence.
