IN THE HIGH COURT OF JUDICATURE AT HYDERABAD

FOR THE STATE OF TELANGANA & THE STATE OF ANDHRA PRADESH * * * WRIT PETITION No. 27210 of 2015 BETWEEN R.Sekhar Babu and another ... PETITIONERS AND The State of A.P., Rep. by its Principal Secretary, Revenue (Stamps & Registration) Department and others ...RESPONDENTS Date of Order pronounced: 26.08.2015 SUBMITTED FOR APPROVAL:

THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR

1. Whether Reporters of Local newspapers Yes/No may be allowed to see the Judgments?

2. Whether the copies of judgment may be Yes/No marked to Law Reporters/Journals?

3. Whether his Lordship wish to see the Yes/No fair copy of the Judgment?

ORDER:- I am not satisfied with the contentions of the learned counsel for the petitioners as the registering authority is bound to register a document, which is in conformity with the Indian Registration Act and the Indian Stamp Act. If the petitioners seek to assert title to the property, which is dealt with by the Registrar by registering it at the instance of third party, petitioners have to take appropriate remedy. The representation filed by the petitioners with regard to asserting title to the property cannot be considered by the Registrar as he is not empowered to decide the title.

Writ petition is accordingly dismissed. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
