CVNR, J & JUD, J Dated:29.6.2017 JUDGMENT: (per Hon'ble Sri Justice C.V.Nagarjuna Reddy) This Civil Miscellaneous Appeal is filed against order and decree, dated 30.12.2016, in HMOP.No.50 of 2015 on the file of the learned Senior Civil Judge, Repalle, Guntur District, whereby he has granted decree for dissolution of marriage between the appellant and the respondent.
During the hearing of the case, on the initiative taken by this Court, both parties have settled the dispute and accordingly, they have also filed a joint memo of compromise, dated 09.6.2017, requesting to confirm the decree, dated 30.12.2016 in HMOP.No.50 of 2015 on the file of the learned Senior Civil Judge, Repalle, Guntur District, by recording the terms of the joint memo of compromise.
On 15.6.2017, Mr. Kowturu Pavan Kumar, the learned counsel for the respondent, requested for an adjournment to enable his client to pay the sum of Rs.6 lakhs agreed to be received by the appellant as full and final settlement of her claim. Accordingly, the case is adjourned.
Today, the respondent, who is personally present, has handed over a Demand Draft for a sum of Rs.6 lakhs to the appellant. On receipt of the said Demand Draft, the appellant has agreed for disposal of the appeal by confirming the decree of divorce in terms of the joint memo of compromise .
CVNR, J & JUD, J Dated:29.6.2017 Accordingly, order and decree, dated 30.12.2016, in HMOP.No.50 of 2015 on the file of the learned Senior Civil Judge, Repalle, Guntur District are confirmed in terms of the joint memo of compromise, which shall form part of the order. The Civil Miscellaneous Appeal, is accordingly, disposed of.
As a sequel to disposal of the Appeal, interim order, dated 09.02.2017, in CMAMP.No.139 of 2017 is vacated and CMAMP.Nos.139, 140 and 141 of 2017 are disposed of as infructuous.
