THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.754 OF 2024 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused in Crime.No.26 of 2023 on the file of Shameerpet Police Station, Cyberabad, registered for the offences under Sections 354D & 506 of IPC and Section 11 r/w.12 of Protection of Children From Sexual Offences Act,2012 (for short 'POCSO Act').

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

The Shameerpet Police arrested this petitioner on 12.01.2024 on the ground that this petitioner was stalking the daughter of the complainant. On 11.01.2024, he caught hold of the hand of the victim girl and loudly declared that she is his lover. On the basis of the said incident , the complaint was filed. 4.

Since all the offences are punishable upto 3 years and since the petitioner is aged 20 years, the relief of regular bail can be considered, subject to following conditions:-

i) The petitioner/Accused shall execute personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties, for a like sum each to the satisfaction of the VI Additional Metropolitan Magistrate, at Medchal.

ii) The petitioner/Accused after release shall appear before concerned Station House Officer at 10:00 a.m. everyday for a period two weeks for the purpose of investigation and thereafter, as and when required. iii) The petitioner/Accused shall not in any manner try to contact or go near the victim girl. Failing which, the Police are entitled to seek cancellation of bail granted. iv) The petitioner/Accused shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C. 5.

Accordingly, this Criminal Petition is allowed.
