THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.757 OF 2024 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused No.3 in Crime.No.255 of 2023 on the file of Haveli Ghanpur Police Station, Medak District, registered for the offences under Sections 366 (A), 376(2) (n) of IPC, Section 5(l) r/w. 6 of POCSO Act, 2012, Section 9 of the Prevention of Child Marriage Act and Section 3(ii) (va) of SCs/STs POA Act.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

The case of the petitioner is that he has helped A-1, A-2 and the victim girl to reach Maisamma temple. There A-1 married the victim girl forcibly. The allegation of rape and abduction is against A-1.

Since the allegation against the petitioner is one of transporting the accused and the victim girl to Maisamma temple, the prayer for regular bail can be considered, subject to following conditions:-

i) The petitioner/Accused No.3 shall execute personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties, for a like sum each to the satisfaction of the Judicial Magistrate of First Class at Medak.

ii) The petitioner/Accused No.3 after release shall appear before concerned Station House Officer at 10:00 a.m. on every Monday for a period four weeks for the purpose of investigation and thereafter, as and when required. iii) The petitioner/Accused No.3 shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C. 5.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed. __________________ K.SURENDER, J Date : 25.01.2024 dv
