THE HON'BLE SMT JUSTICE T.RAJANI CRIMINAL PETITION No. 450 of 2018 Between:
1. Kuruva Madhushekar, S/o. Late Yella Ramudu
2. Kuruva Manohar, S/o. Late Yella Ramudu
3. Smt. Kuruva Laxmi Devi, W/o. Late Yella Ramudu
4. Smt. K.Mayyuri @ Madubala, W/o. Respondent/Complainant Petition under Section 438 of Cr.P.C. praying that in the circumstances stated in the grounds filed herein, the High Court may be pleased to enlarge the petitioners herein on bail in the event of their arrest in connection with cr.No. 833 of 2017 of Neredmet Police Station, Rachakonda District.
The Petition coming on for hearing, upon perusing the petition and the grounds filed herein and upon hearing the arguments of Sri T.Kumar Babu, Advocate for the Petitioners and of the Public Prosecutor (TG) for the Respondent, the Court made the following ORDER:
" This petition is filed seeking for grant of anticipatory bail to the petitioners, who are A1 to A4, in Crime No.833 of 2017 on the file of the Station House Officer, Neeredmet Police Station, Rachakonda District. The offences alleged are under Sections 498-A IPC and Sections 3 and 4 of Dowry Prohibition Act, 1961.
2.
Heard the counsel for the petitioners and the Public Prosecutor appearing for the respondent.
3.
A perusal of the complaint would show that there are no allegations, which would constitute the alleged offences. The allegations, if any, constituting the alleged offences seem to have been made only on the grudge of the de facto complainant had with regard to the transfer of A1. 4.
Hence, in view of the above, this court opines that this is a fit case for granting anticipatory bail to the petitioners. 4.
Accordingly, the Criminal Petition is allowed. The petitioner is directed to surrender before the Station House Officer, Neeredmet Police Station, Rachakonda District, within 15 days from the date of this order. On such surrender, the petitioners shall be released on bail on their executing personal bonds for a sum of Rs.10,000/- (Rupees ten thousand only) each with two sureties each for a like sum each to the satisfaction of the said Station House Officer. ..2..
