THE HON'BLE DR. JUSTICE B.SIVA SANKARA RAO WRIT PETITION No.18810 OF 2017 ORDER:

This writ petition is filed, under Article 226 of the Constitution of India, for the following relief: "to issue a Writ, one in the nature of a Writ of Mandamus or any other appropriate Writ, direction or order declaring the Proceedings D.Dis No.1/2152/2016 dated 12.04.2017 passed by the 3rd respondent as illegal and arbitrary and violative of the provisions of the Andhra Pradesh Scheduled Commodities Control Order, 2008, and consequently set aside the same, in the interest of justice, and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

Heard learned counsel for petitioner and also the learned Government Pleader for Civil Supplies, representing the respondents.

It is the submission of the petitioner that he already filed detailed explanation against the impugned order dated 12.04.2017 of the Revenue Divisional Officer, vide D.Dis.No.I/2152/2016 and further submitted that against the impugned order of cancellation, he filed an appeal before the Collector (C.S.), Prakasam District at Ongole, and the same is pending since 18.04.2017.

Having regard to the above, this writ petition is disposed of, directing the 2nd respondent - Joint Collector (C.S.) to call for the record from the 3rd respondent and dispose of the appeal within four weeks from the date of receipt of a copy of this order. The petitioner is directed, pursuant to this order, to appear before the Collector (CS) in the said appeal without fail on 23.06.2017.

Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence. No order as to costs.
