THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.32842 of 2017 ORDER:

The present Writ Petition, under Article 226 of the Constitution of India, came to be filed seeking to declare the inaction of respondents and in considering the recommendation made by the fourth respondent for extension of dealership of the petitioner, as illegal and arbitrary. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Civil Supplies. With their consent, the Writ Petition is disposed of at the stage of admission itself.

The case of the petitioner is that he was appointed as fair price shop dealer at Pothareddypally Village on temporary basis. After completion of three months, the dealership was extended for a period of six months vide proceedings dated 05.05.2015. After expiry of said period also, the petitioner was allowed to distribute the essential commodities till June, 2017. In the month of July, 2017, the allotment was stopped to the petitioner on the ground that the petitioner was not holding e-pass machine. The fourth respondent vide letter No.A/624/2015 dated 26.05.2017 requested respondents 2 and 3 to consider the request of the petitioner to extend the period of dealership for a period of six months. Inaction on the part of respondents 2 and 3, led to filing of the present writ petition.

Learned counsel for the petitioner submits that though the Tahasildar vide his letter dated 26.05.2017 recommended that the

request of the petitioner can be considered by extending his dealership for six months, the same was not considered by respondents 2 and 3.

Learned AGP would submit that appropriate decision will be taken by the authorities at the earliest.

Having regard to the above, the Writ Petition is disposed of directing the third respondent-The Revenue Divisional Officer to deal with the aspect of extending the temporary dealership of the petitioner for a period of six months and pass appropriate orders, at the earliest, in accordance with law.

Consequently, miscellaneous petitions pending in this petition, if any, shall stand closed.
