HONOURABLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.11407 of 2009 ORDER:

The petitioner states that he is the owner and possessor of the property bearing No.65-17-1/A, Mehar Nagar, Kakinada. When the respondent sought to lay a road by demolishing the existing structures in the private property of the petitioner abutting the drainage without any notification or initiating any action under the provisions of Section 146 and 147 of the Hyderabad Municipal Corporation Act 1955 or under the provisions of the Land Acquisition Act or by private negotiations, the present writ petition was filed.

This Court by order dated 11.06.2009 directed the respondent not to interfere with the property claimed by the petitioner without following due process of law. The said order has been in operation till today. Even after seven years, no counter-affidavit is filed by the respondent. In view of the same, the interim order dated 11.06.2009 is made as a final order.
