This Criminal Petition, under Section 482 of the Code of Criminal Procedure, 1973, is filed by the petitioner/ respondent, requesting to recall the Non-bailable Warrant issued against him by the learned Judicial Magistrate of First Class, Dharmavaram, Anantapur District, in M.C.No.28 of 2011.

Heard the learned counsel for the petitioner/ respondent, learned Assistant Public Prosecutor representing the 1st respondent-State and perused the record.

In the course of submissions, it has come to light that the petitioner is ready to deposit the arrears of maintenance provided some time is given to him. The main purpose of issuance of Non-bailable Warrant by the Court below against the petitioner is to recover the arrears of maintenance due from the petitioner, who is the ex-husband of respondent No.2. 4 .

Under these circumstances, the petitioner is directed to deposit 50% of the entire arrears of maintenance due by him, to the credit of M.C.No.28 of 2011, within a period of two (02) weeks from today. On such deposit, the Court below shall recall the Non-bailable Warrant pending against the petitioner and recover the balance amount of arrears of maintenance from him, in accordance with law.

The Criminal Petition is allowed accordingly.

Miscellaneous petitions, if any, pending in this Criminal Petition, shall stand closed.
