Heard learned counsel for the petitioner and learned Government Pleader for Revenue.

With the consent of both the parties, the Writ Petition is disposed of at the admission stage.

The present Writ Petition came to be filed seeking issuance of writ of Mandamus declaring the action of respondent Nos.2 to 4 in not disposing the application dated 10.03.2013 made for issuance of pattadar pass book in respect of land situated in Survey Nos.246, 263/1, 263/2 of Adavivaram Village, Visakhapatnam Urban and District and trying to dispossess the petitioner from the land during pendancy of same, without issuing any notice or following the procedure contemplated under law as illegal and arbitrary. 4.

It is to be noted that there is a procedure prescribed under the provisions of Rights in Land and Pattadar Pass Books Act for issuance of pattadar pass book and title deeds. Hence, the question of issuing pattadar pass books would not arise basing on the representation made to the Revenue Divisional Officer. In fact, it is only the Tahsildar who is competent authority to issue pattadar pass book and title deeds.

Having regard to the above, I am not inclined to consider the request of the petitioner. But, however, the petitioner, if so advised, shall make a suitable application in the prescribed form seeking

issuance of pattadar pass book and title deeds, in which event the respondent-authorities shall deal with the same in accordance the provisions of law, at the earliest.

Accordingly, the writ petition is disposed of. 7.
