Heard Sri P. Nagendra Reddy, learned counsel for the petitioner, and the learned Government Pleader for Civil Supplies appearing for the respondents.
2. Stock of rice was seized from the petitioner's rice mill by the respondent-officials under a panchanama dated 20.11.2015. The petitioner seeks release of the said stock of rice and states that he would furnish bank guarantee to the satisfaction of the 2nd respondent. Learned Government Pleader for Civil Supplies appearing for the respondents states that the proceedings under Section 6A of the Essential Commodities Act, 1955 (for short, 'the Act') have been initiated against the petitioner and that the bank guarantee, which the petitioner is given, should be kept alike during the pendency of the proceedings under Section 6A of the Act.
3. Having regard to the said submission, the writ petition is disposed of directing the petitioner to furnish a bank guarantee to the value of the seized stock to the satisfaction of the 2nd respondent and subject to the said bank guarantee being kept alike during the pendency of the proceedings under Section 6A of the Act against the petitioner. There shall be no order as to costs. The miscellaneous petitions pending, if any, shall stand closed.
