THE HONOURABLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.8866 of 2013 ORDER:

In this Petition filed under Section 482 Cr.P.C., the petitioner/accused No.5 seeks to quash the proceedings in Cr.No.69 of 2012 on the file of Wardhannapet Police Station, Warangal District, whereunder the petitioner along with four others were charged for the offences under Section 306 r/w 34 IPC. When the matter came up for hearing, learned Public Prosecutor by producing a copy of the charge sheet submitted that the police have filed charge sheet on 24.09.2013, which was taken cognizance and registered as SC.No.196 of 2014 by the learned VII Additional District Judge-cum-SCs & STs Court, Warangal, and hence, the instant petition, which is filed for quashment of the proceedings in Cr.No.69 of 2012, has became infructuous and prayed to dismiss the petition.

Upon which, the learned counsel for petitioner has made an endorsement on the back of the petition seeking permission to withdraw the Criminal Petition with a liberty to challenge the charge sheet by initiating appropriate proceedings. In view of the submissions of both sides, this Criminal Petition, which is filed for quashment of the proceedings in Cr.No.69 of 2012, is dismissed as infructuous and liberty is given to the petitioner/A.5 to challenge the charge sheet by initiating appropriate proceedings.

Consequently, the miscellaneous petitions, if any, pending, in this case, shall stand closed.
