Penugonda Yuvaraja v. State Of Andhra Pradesh, Rep By Its Principal Secretary
THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.30070 of 2011 ORDER:
The grievance of the petitioner in this case was that the police authorities were not taking steps to investigate Crime No.141 of 2011 on the file of Railway Kodur Police Station, Kadapa District. Basing on the written instructions dated 01.07.2015 received from the Sub-Inspector of Police, Railway Kodur Police Station, Kadapa District, the learned Assistant Government Pleader for Home informed this Court that initially Crime No.141 of 2011 had been registered as a 'Woman Missing' case upon the complaint made by the petitioner to the effect that his sister - Vempati Kalpana was missing. However, the case was thereafter altered to one under Sections 302, 379, 201, 109 and 120-B I.P.C. read with Section 34 I.P.C. Upon due investigation, the police authorities found that the petitioner's sister had been murdered by the 6th respondent herein along with others. A charge sheet was laid before the learned Judicial First Class Magistrate, Railway Kodur Police Station, Kadapa District, vide P.R.C.No.3 of 2014.
A copy of the said charge sheet is also placed on record. In the light of the aforestated developments, the complaint of the petitioner as to the alleged inaction on the part of the police authorities is shown to be without basis.
The writ petition is accordingly dismissed.
Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
