This appeal is filed by the insurance company under Section 173 of the Motor Vehicles Act, challenging the judgment and decree dated 14.9.2011 passed in MVOP No.151 of 2010 on the file of the MACT-cum-II Additional District Judge (FTC), Srikakulam.

At the time of hearing, learned counsel for the appellant seeks permission of this court to permit the appellant to withdraw the appeal. A letter dated 24.4.2017 to that effect was also addressed by the learned counsel for the appellant to the Registry.

Accordingly, the MACMA is dismissed as withdrawn. Miscellaneous petitions if any pending in this appeal shall stand closed.
