THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.10554 of 2016 ORDER:

Heard the learned counsel for petitioner and the learned Government Pleader for Home appearing for respondents. 2.

Petitioner's grievance is that petitioner had lodged a complaint, on the basis of which F.I.R.No.149 of 2015 was registered, but investigation has not been completed.

Learned Government Pleader for Home appearing for respondents states that investigation has been completed and even charge sheet has been filed before the Special Judicial Magistrate of First Class for Railways, Nellore in respect of certain offences alleged to have been committed by the accused under the provisions of the Indian Penal Code.

Learned counsel for petitioner states that the allegations made by petitioner attracts the provisions of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989, and in the charge sheet, the respondents ought to have included the charges under the said enactment.

Since the petitioner has adequate remedy under the provisions of the Code of Criminal Procedure for seeking correction or inclusion of charges under the said enactment before the said Court, I am not inclined to go into the said issue.

Therefore, granting liberty to petitioner to take appropriate action in accordance with law for seeking inclusion of charges under the said enactment before the said Court or other competent Court, the Writ Petition is disposed of. No costs.

As a sequel, the miscellaneous petitions pending, if any, shall stand closed.
