HON'BLE SRI JUSTICE U.DURGA PRASAD RAO Criminal Petition No.585 of 2018 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C by the petitioner/A.3 seeking to quash the proceedings in Crime No.252/2017 of Regonda PS, Jayashankar (Bhupalpally) District, registered for the offences under Sections 324, 504 r/w 34 IPC, Section 3(1)(r)(s), 3(e), 3(2)(v)(a) of SC, ST (POA) Act, 2015. 2) Investigation is reported to be pending.

3) Having regard to the fact that the complaint allegations mainly relate to the land dispute and also that Investigating Officer examined LWs.1 to 9, this Court is of the view that investigation has to be completed expeditiously. Therefore, the Investigating Officer is directed to proceed with the investigation and during which course he shall strictly follow the guidelines rendered by Hon'ble Apex Court in the decision reported in Arnesh Kumar vs. State of Bihar1 and also the procedure contemplated under Section 41-A Cr.P.C towards the petitioner/A.3. In turn, the petitioner/A.3 shall cooperate with the investigating agency for smooth completion of investigation.

4) Accordingly, this Criminal Petition is disposed of. As a sequel, miscellaneous petitions pending if any, shall stand closed.
