Heard the learned counsel for the petitioner and the learned Government Pleader for Revenue appearing for respondents 1 to 3. With consent of the counsel appearing for both sides, the present writ petition is disposed of at the admission stage. 2.

Since this Court is not adjudicating the matter on merits, it may not be necessary to put the 4th respondent on notice. 3.

The present writ petition came to be filed with the following prayer:

"to issue an appropriate writ, order or direction, more particularly one in the nature of Writ of Mandamus, declaring action of the Respondent Nos.2 and 3 in not considering representation sent on 24.09.2016 and trying to release the Exgratia/compensation amount to 4th Respondent in respect of land in Survey No.241 (241/3~) admeasuring Ac.3.85 cents situated at Vangali Village, Sabbavaram Mandal, Visakhapatnam District, Andhra Pradesh as arbitrary, illegal, discriminative, in violation of principles of natural justice, violative of Fundamental Right guaranteed under Articles 14 and 300-A and Right guaranteed under Constitution of India."

Though various grounds are raised, learned counsel for the petitioner submits that in spite of the representation dated 24.09.2016 made by the petitioner seeking release of extratia/ compensation in respect of the land in dispute, the respondent

CPK,J WP_36912_2016 authorities are trying to release the amount in favour of the 4th respondent.

Learned Government Pleader for Revenue submits that the representation of the petitioner can be considered, provided he is entitled for the said amount.

Having regard to the above, the Writ Petition is disposed of directing the 3rd respondent to consider the representation dated 24.09.2016 made by the petitioner seeking compensation, in accordance with law. It is needless to mention that respondent No.4, to whom compensation is sought to be made, shall also be heard before passing any order on the representation made by the petitioner.
