HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.26596 of 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking a writ of Mandamus declaring the action of the respondents in erection of M+6 Towers, 11 KV, 33 KV and 132 KV and LT Lines in Agricultural Lands of petitioner, as illegal and arbitrary.

2. Heard the learned counsel for the petitioner, Sri R.Vinod Reddy, learned standing counsel appearing for respondents 1 and 3 to 5 and the learned Government Pleader for Energy (Telangana).

3. A perusal of the record reveals that the petitioner is the owner of an extent of Ac.1.04 guntas in Survey No.130 and Ac.3.13 guntas in Survey No.136 of Lalgadi, Malakpet village, Shameerpet Mandal of Ranga Reddy District. It is the further case of the petitioner that the respondents herein erected the electrical poles in his land without paying compensation as per law. A perusal of the record further reveals that the petitioner herein submitted a representation to the respondents on 23.07.2016 claiming compensation as per law.

4. At the time of arguments, the only relief sought by the petitioner is to direct the third respondent to dispose of his representation dated 23.07.2016 seeking compensation. The learned standing counsel consented for disposal of the representation of the petitioner.

5. Having regard to the facts and circumstances of the case

and also in view of the submissions made by learned counsel for both parties, the third respondent is hereby directed to dispose of the representation of the petitioner dated 23.07.2016 in accordance with law as expeditiously as possible, preferably, within six weeks from the date of receipt of copy of this order.

6. Accordingly, this writ petition is disposed of. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
