HON'BLE SRI JUSTICE U.DURGA PRASAD RAO WRIT PETITION No.15685 OF 2010 ORDER:

The petitioners seek writ of Mandamus declaring the action of respondent in proposing to deduct the crop insurance premium from the crop loan amounts released and to be released to the petitioners at the rate of 1% to 12% towards the crop insurance premium for the Kharif and Rabi seasons 2009-2010 without the consent of the petitioners as arbitrary, illegal and in violation of the Articles 14 and 21 of the Constitution of India and in contrary to the principles of natural justice and consequently direct the respondent not to insist upon the petitioners to pay the insurance premium on the loans advanced and to be advanced to them and pass such other order.

Today, the matter is listed under the caption 'for dismissal' and in spite of the same, there is no representation for the petitioners. It appears the petitioners are not interested to prosecute the matter. Added to it, since the relief sought for is in respect of the crop period of 2009-2010, which was over long back, the writ petition became infructuous.

Recording the said submission, this writ petition is dismissed as infructuous. As a sequel, miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
