HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.41121 OF 2016 ORDER:
The case of the petitioner is that he was issued notice dated 30.09.2016 in Form II under Rule-3 of the A.P.Assigned Lands (Prohibition of Transfers) Rules, 2007, by the 4th respondent to submit explanation and that in pursuance of the same the petitioner also submitted explanation. But, without passing any orders on the same, the respondents are trying to evict dispossess the petitioner from the subject land. Aggrieved by the same present writ petition is filed.
Heard both sides.
Since it is stated that petitioner has already submitted explanation in pursuance of the notice dated 30.09.2016, the 4th respondent is directed to consider the same and pass orders, in accordance with law, after giving notice to the affected parties, if any, and after giving opportunity of hearing to the petitioner. Till passing of such orders, status quo obtaining as on today shall be maintained by both the parties. With the above direction, the writ petition is disposed of. No order as to costs.
As a sequel thereto, miscellaneous applications, if any, pending, shall stand closed.
