THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI IA.No.1 of 2018 in/and A.S.No.641 of 2007 JUDGMENT:

The unsuccessful 1st defendant filed this Appeal Suit under Section 96 read with Order 41 Rule 1 of the Code of Civil Procedure, 1908, assailing the decree and judgment, dated 12.09.2007, of the learned Senior Civil Judge, Chirala, passed in OS.No.4 of 2006. 2.

When the appeal is taken up for hearing, learned counsel for the appellant stated that IA.No.1 of 2018 is filed for permission to withdraw the Appeal Suit since the subject matter is adjusted out of Court. He also stated that the documents evidencing the adjustment outside the Court by means of one time settlement scheme are also filed with the interlocutory application. He, accordingly, prayed for dismissing the Appeal Suit as withdrawn after recording the submission that the matter is adjusted out of Court.

Accordingly, IA.No.1 of 2018 is ordered. Recording the submission that the matter is adjusted out of Court, the Appeal Suit is dismissed as withdrawn.

There shall be no order as to costs.
