HON'BLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.1671 of 2020 ORDER :

The relief sought in the writ petition is as under: "..... this Hon'ble Court may be pleased to issue a writ order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the 2nd respondent in interfering with the sale and distribution of Bio-Products of petitioner Company i.e. Magnet, Rocket, Humic Super, Humic Super Granule, Maxima, Speed, Growth Power, Tryzyme, Sulpurplus, Nitrocharge, Zyme+ Supersil(L), Supersil(P), Zicom, Stick Up, Sardar(L), Himraj80, Blue Diamond, Blue Star, Bordo Max, Bordo Powder, Fighter, All in One, Tridev, Growth Plus+, Cyzer, pH Balncer and Bahar, by issuing Memo.

No.PP.II(1)2085/2005, dt.21.01.2006 and Letter No.PP.II(1)2085/2005, dt.21.01.2006 as being illegal, arbitrary, unconstitutional and without jurisdiction and further direct the 2nd respondent not to interfere with in any manner in the sale and distribution of bio-products including from the licensed premises of the dealers/stockists under the Insecticides Act, 1968 and the Fertilizers Control Order Act, 1985 and to pass such other order or orders ....."

Heard learned counsel for the petitioner as well as the learned Government Pleader for Agriculture appearing for the respondents.

When the matter came up for hearing, learned counsel for the respective parties submits that the issue involved in this writ petition is squarely covered by the judgment

PKR,J W.P.No.1671 of 2020 dt.03.11.2016 in W.A.Nos.1122 and 1136 of 2016 passed by a Division Bench of this Hon'ble Court.

In the light of the submissions made by the learned counsel for the respective parties and also in the light of the prayer sought in the writ petition, this writ petition is disposed of in terms of the judgment dt.03.11.2016 in W.A.Nos.1122 and 1136 of 2016 passed by a Division Bench of this Hon'ble Court. No order as to costs.

As a sequel, miscellaneous applications pending, if any, shall stand closed.
