THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.771 of 2024 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by petitioner/Accused No.4 seeking anticipatory bail in the event of her arrest in connection with Crime No.1059 of 2023 on the file of P.S.Madhapur, Cyberabad, registered for the offences punishable under Sections 370, 370(A)(2) of the Indian Penal Code and Sections 3, 4, 5 of the Immoral Traffic Prevention Act.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

The case of the Madhapur police is that they conducted raid in a premises at Madhapur and found running brothel business therein. This petitioner was not present during the course of raid, however, she was identified as sub-organizer during the course of investigation.

Learned counsel for the petitioner would submit that the petitioner has nothing to do with the premises nor alleged running of brothel business.

Learned Additional Public Prosecutor on instructions would submit that there are no other cases registered against this petitioner.

In the said circumstances, this Court is inclined to grant the relief of anticipatory bail to the petitioner, subject to the following conditions:-

1) The petitioners/Accused No.4 is directed to surrender before the Station House Officer, Madhapur Police Station, Cyberabad on or before 31.01.2024. On such surrender, the said Station House Officer shall release the petitioner on bail, on her executing personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties for a like sum each to his satisfaction.

2) On such release, the petitioner/Accused No.4 shall appear before the concerned police on every day at

10am for a period of ten (10) days for the purpose of investigation and thereafter, as and when required.

3) The petitioner/Accused No.4 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
