Heard learned counsel for the parties.

This writ petition impugns the order of dismissal passed against the petitioner based on the final order in departmental enquiry dated 17-01-2015. Mr. J. Anil Kumar, learned Standing Counsel appearing for respondent Nos.2 and 3, at the outset, invited our attention to Rule 9(x) of the Andhra Pradesh Civil Services (Classification, Control and Appeal) Rules, 1991 (for short, 'the Rules') and also Rule 34 (ii) and submitted that the order impugned in the writ petition is appealable under this provision.

Having confronted with this, Mr. Nageswara Rao Pappu, learned counsel for the petitioner prays for withdrawal of this writ petition with liberty to the petitioner to file appeal under Rule 34(ii) of the Rules.

Writ petition is disposed of as withdrawn with liberty as prayed. It is needless to mention that the petitioner shall file an application along with the appeal for condonation of delay, if any, and if any such application is filed, we hope and trust that the appellate authority shall consider the application for condonation of delay sympathetically and decide the appeal on merits in accordance with law. All contentions on merits are kept open.
