.....Respondent/ Complainant Petition under section 438 of Cr.PC., praying that in the circumstances stated in the memo of grounds herein, the High Court may be pleased to direct the Station House Officer, Easgaon to release the Petitioners on Bail in the event of their arrest in connection with Crime No.5/2015, Easgaon P.S.

The petition coming on for hearing, upon perusing the Petition and the memo of grounds filed herein, and upon hearing the arguments of Sri D. Pochaiah, Advocate for the Petitioners, and of Public Prosecutor (TG) for Respondent, the Court made the following. ORDER:

The petitioners, who are accused in Crime No.5 of 2015 of Easgaon P.S. of Adilabad District, registered for the offences under Sections 498(A) and 494 IPC, 3 & 4 of the Dowry Prohibition Act and 156 (3) Cr.P.C., filed this petition under Section 438 of Cr.P.C., seeking anticipatory bail.

1st petitioner - A1 is the husband, petitioners 2 and 3 - A2 and A3 are the parents-in-law, 4th petitioner - A4 is the sister-in-law of the de facto complainant. 5th petitioner - A5 is the husband of A4. 6th petitioner - A5 is the second wife of A1. It is alleged that A1 to A5 harassed the de facto complainant for demand of additional dowry

and they also necked out her from their house. It is also alleged that A1 married A6 while subsisting the marriage with the de facto complainant.

Having regard to the facts and circumstances of the case and also the allegations are not so serious in nature, this Court is inclined to grant anticipatory bail to the petitioners. In the circumstances, the petitioners-Accused are directed to surrender before the Investigating Officer within ten days from today and on such surrender, they shall be enlarged on bail on their executing personal bond for a sum of Rs.5,000/- (Rupees five thousand only) each with one surety for the like sum each to the satisfaction of the Arresting Officer. Further, the petitioners are directed to report before the Station House Officer, concerned, as and when required.
