This Petition coming on for hearing, upon perusing the Memorandum of Grounds of criminal Petition and upon hearing the arguments of sri UMESH SINGH, Advocate for the Petitioner and of the Public Prosecutor (TG) on behalf of the Respondent.

THE HONOURABLE JUSTICE G, SRI DEVI CRIM AL PETITIoN No.592 OF 2O2l ORDER:
This Criminal Petition, under Section 43g of the Code of Criminal Procedure, 1973 (for short, ,Cr.p.CJ, is filed by the petitioner/Accused No.S for grant of anticipatory bail in the event of his arrest in connection with Crime No.3g9 of 2O2O of Dhoolpet Prohibition and Excise Station, Hyderabad, registered for the offence punishable under Section 8 (c) read with 20 (b)(ii) (c) of the Narcotic Drugs and Psychotropic Substances Act, I9g5 (for short, 'NDPS Act).
Heard learned counsel for the petitioner/ Accused No.S and the learned Additional public prosecutor representing the respondent/ State. Perused the record.

Learned counsel for the petitioner would submit that the petitioner is innocent of the offence alleged against him; that the petitioner did not commit any offence as alleged by the prosecution; that the respondent-police have falsely implicated the petitioner in the present case and ultimately, prayed to grant anticipatory bail to the petitioner.
Learned Additional Public prosecutor opposed the petition. 5.
As seen from the contents of the First Information Report, total 38.5 kgs., of Ganja was recovered from the possession of accused No.2, who purchased the same from accused No.3, who in turn trying to sell the same to the present petitioner/ accused No.5

Thus, in view of nature of allegations levelled against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. However, the petitioner/A.S is directed to surrender before the Court concerned within a period of ten (1o) days from today and move an application for regular baii, after giving prior notice to the Public Prosecutor concerned. If any such application is filed, the said application shall be considered in accordance with law.
With above observations, the Criminal Petition is dismissed' Miscellaneous petitions, if any, pending in this petition shall stand closed.
