THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.2055 OF 2015 ORDER:

This petition is filed by the petitioner-accused No.2 under Section 482 Cr.P.C. seeking to quash the proceedings against him in C.C.No.236 of 2013 on the file of the XI Additional Chief Metropolitan Magistrate, Secunderabad.

Heard and perused the material available on record. The petitioner is alleged to have committed the offence punishable under Sections 406 and 420 r/w Section 120(b) IPC. It is alleged that the petitioner, who is the co-brother of the 2nd respondent, introduced A1, who is working for a foreign organization called "ECOWAS", as his friend. Due to regular visits of A1 to the house of A2, the 2nd respondent got acquaintance with him. At the request of A2 to A4, the 2nd respondent arranged amounts to A1 for his urgent financial necessities. Later A1 did not turn up to repay the said amount. Considering the facts and circumstances of the case and the allegations made against the petitioner, this Court is not inclined to interfere with the proceedings in the above C.C.

At this stage, the learned Counsel for the petitioner prayed for dispensing with the presence of the petitioner before the trial Court. In view of the above submission, the presence of petitioner-A2 before the trial Court is dispensed with except on the date of framing of charges, if any, and on the date of examination under Section 313 Cr.P.C. and on the date of pronouncement of judgment in the above C.C. The petitioner is directed to be represented by his Counsel before the trial Court on all hearing dates.

Accordingly, the Criminal Petition is disposed of. Consequently, miscellaneous petitions pending, if any, shall stand closed. ______________________
