Upon hearing both sides, at the admission stage, the following Order is passed:
Since the trial Court has taken cognizance against A.1 to A.5 including the present petitioners/A.4 and A.5, this Court is not inclined to quash the proceedings against the present Petitioners/A.4 and 5. However, if the petitioners are so advised, they can move discharge applications before the trial Court, in which case, the trial Court shall dispose of the said discharge applications on merits at the earliest. It is brought to the notice of this Court that the trial Court while taking cognizance of the Charge sheet issued N.B.Ws against the present Petitioners. Now, the learned counsel for petitioners prayed to order recalling of said N.B.Ws. Considering it, the petitioners/A.4 & 5 are directed to appear before the trial Court on or before 31-03-2015 and on their appearance, the learned I Additional Judicial First Class Magistrate, Kadapa, shall recall the N.B.Ws issued against them.
With the above observation, the Criminal Petition is disposed of. As a sequel, miscellaneous applications pending, if any, shall stand closed. ______________________ U.DURGA PRASAD RAO,J 17-03-2015 eha.
