HONOURABLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.8836 OF 2001 ORDER:

This Writ Petition is filed challenging the orders passed by the first respondent in Appeal No.33 of 2000 dated 5th March, 2001 wherein the petitioner has challenged the orders passed by the Controlling Authority under Payment of Gratuity Act and Assistant Labour Commissioner (Central), Hyderabad, wherein the Controlling Authority had awarded gratuity of Rs.1,06,490-23ps along with interest at the rate of 10% per annum amounting to Rs.19,523-20ps for the period from 6-9-1998 to 5-7-2000 to be paid in favour of the second respondent herein.

The appellate authority had dismissed the appeal preferred by the petitioner on 5th March, 2001. Hence, the petitioner filed this Writ Petition. This court by order dated 21-9-2004 had dismissed the Writ Petition against the second respondent. Since the contesting respondent is not before this court consequent upon the orders passed by this court on 29th April, 2009, the lis in the Writ Petition cannot be adjudicated and as such, the same is liable to be dismissed.

Accordingly, this Writ Petition is dismissed without costs. As a sequel, miscellaneous applications pending, if any, shall stand closed.
