HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.41027 OF 2016 ORDER:
This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking to declare the inaction of respondents 2 and 3 in taking steps for demarcating the boundaries in respect of land in survey No.310 admeasuring Ac.1-4 1⁄2 guntas situated at Mancherial Shivar, Mandamarri Mandal, Mancherial District, by conducting survey, as illegal and arbitrary.
Heard the learned counsel for the petitioner as well as the learned Assistant Government Pleader for Revenue for respondents. With their consent, the writ petition is disposed of at the stage of admission itself.
Inspite of there being an order passed by this Court in WPMP No.17970 of 2016 in W.P.No.14423 of 2016, on 25.04.2016, directing the authorities to conduct survey in respect of lands covered by survey Nos.310 and 324 of Mancherial Shivar, Adilabad District, the authorities failed to conduct survey. Learned AGP would submit that copy of said order was not communicated to the respondents. However, learned counsel for the petitioner submits that on 03.05.2016 he made a representation before the 2nd respondent along with a copy of the order passed by this Court in WPMP No.17970 of 2016 and as such the plea taken by the respondents in incorrect.
Having regard to the rival submissions made, without going into the merits of the case, the Writ Petition is disposed of directing the 2nd respondent-Collector to take steps for conducting survey in terms of the order passed by this Court on 25.04.2016 in WPMP No.17970 of 2016 in W.P.No.14423 of 2016 in respect of lands covered by survey Nos.310 and 324 of Mancherial Shivar, Adilabad District, within a period of two weeks from the date of receipt of a copy of this order. Learned counsel for the petitioner shall communicate a copy of this order to the 2nd respondent. Learned AGP shall inform the 2nd respondent about the order passed by this Court.
Miscellaneous petitions pending in this writ petition, if any, shall stand closed. No order as to costs.
