THE HONOURABLE SRI JUSTICE SURESH KUMAR KAIT AND THE HONOURABLE SRI JUSTICE T. AMARNATH GOUD F.C.A.No.156 of 2017 JUDGMENT: (Per the Hon'ble Sri Justice Suresh Kumar Kait) Vide order dated 08.02.2018 in FCA MP No.207 of 2017 in FCA No.156 of 2017, this Court passed the following order: "This Application is filed for suspension of Order, dated 03.09.2016, in OP.No.1391 of 2012 on the file of the Judge, Family Court, Ranga Reddy District at L.B.Nagar, Hyderabad, pending disposal of the Appeal.

The applicants/appellants and respondent Nos.1 to 3 are personally present.

The applicants have informed the Court that they lost their only son, who is the husband of respondent No.1, and that having got their daughter married off, settling the properties, respondent No.2 is the only male successor to their family. They, therefore, urged that they may be allowed to take respondent No.2 to their house on every Sunday from morning to evening.

Initially, respondent No.1 resisted this request. However, on persuasion by this Court, she agreed to send respondent No.2 with the applicants on every alternative Sunday from 9.00 a.m., to 5.00 p.m. The applicants also undertake that they will not try to prejudice the mind of respondent No.2 against respondent No.1 or her parents. In the light of the above agreement reached between the parties, the following directions are issued:

(1) On every alternative Sunday commencing from 11.02.2018, respondent No.1 shall hand over the custody of respondent No.2 to applicant No.1 at her house around 9.00 a.m.; (2) Applicant No.1 shall hand over the custody of respondent No.2 to respondent No.1 at her house around 5.00 p.m., on the same day; (3) This arrangement shall continue pending further orders in the Appeal.

Today, when the matter came up for hearing, learned counsel appearing on behalf of the appellants submits that the appellants are

SKK, J & TA, J F.C.A.No.156 of 2017 happy with the arrangement made by this Court vide order dated 08.02.2018 and they do not want to pursue the present appeal.

Recording the aforesaid submission, the appeal is closed. No order as to costs. Miscellaneous petitions, if any, pending in this appeal shall stand closed.
