The company petition is filed by the petitioner alleging that the respondent company is unable to pay the debts. Notice before admission was ordered and thereafter the matter was adjourned for couple of times.

Today, when the matter is taken up for hearing, learned counsel for the petitioner submits that his client has instructed to withdraw the company petition and seeks permission of this Court to withdraw the petition.

As the Company Petition is not yet admitted permission is accorded.

Accordingly, the Company Petition is dismissed as withdrawn. No order as to costs.

Miscellaneous petitions, if any pending in this company petition shall stand closed.
