Heard the learned counsel for the petitioner and the learned Government Pleader for the respondents.
The petitioner was appointed as fair price shop dealer for shop No.1 of Gollapalli village, Gummagatta Mandal, Anantapur District. Earlier in the month of July, 2014, the 3rd respondent issued suspension-cum-show cause notice vide Rc.No.931/ 2014/E dated 17.07.2014 placing the petitioner's fair price shop authorization under suspension. In spite of lapse of nearly six months, the 3rd respondent has not conducted any enquiry. Challenging the same, the petitioner filed W.P.No.3032 of 2015 before this Court and this Court revoked the suspension order, directing the 3rd respondent to conduct enquiry and pass final orders. Again, when the respondents did not release the stock to the petitioner's fair price shop for the month of June, 2015, the petitioner filed W.P.No.
19096 of 2015, and after coming to know of the fact of filing of the said writ petition, the 3rd respondent suspended the petitioner's fair price shop authorization on certain allegations. The petitioner withdrew W.P.No.19096 of 2015 with a liberty to question the said suspension orders. Questioning the said suspension of authorization of the petitioner, the present writ petition is filed. This Court carefully perused the allegations levelled against the petitioner and is prima facie of the view of that the same are required to be inquired into. In those circumstances, this Court is not inclined to interfere with the enquiry process at this stage.
thereon, within a period of thirty days from the date of receipt of a copy of this order by duly following the principles of natural justice in the enquiry process.
