THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.4770 OF 2013 ORDER:

This Criminal Petition is filed under Section 482 of Code of Criminal Procedure (Cr.P.C) by the petitioner/accused seeking to quash the proceedings in S.T.C.No.34 of 2012 on the file of the Judicial Magistrate of First Class, Madanapalli, arises out of offence under Section 138 read with 142 of the Negotiable Instruments Act. .

Heard and perused the records.

Learned counsel for the petitioner, after arguing for some time, confined his argument with regard to dispense with the presence of the petitioner before the Court below.

Considering the nature of allegations, the presence of the petitioner/accused before the trial Court is dispensed with except on the dates when the trial Court insists for his appearance.
