HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI CIVIL REVISION PETITION No. 4804 of 2012 ORDER:

This civil revision petition is filed by the defendants 1, 3 and 4, aggrieved by the orders, dated 18.08.2012, passed by the Senior Civil Judge, Razole, in O.S.No.82 of 2005, upholding the objection raised by the plaintiffs in marking a No Objection Certificate, dated 26.12.1999 filed by the defendants, without payment of stamp duty and registration.

Heard the learned counsel on both sides and perused the record. Having considered the rival contentions submitted by the learned counsel, I feel it appropriate to direct the trial Court to frame a separate issue as to whether the unregistered No Objection Certificate, dated 26.12.1999, can be marked or not, and adjudicate the suit on merits as expeditiously as possible, preferably within one year, as it is for declaration of title and it pertains to the year 2005. With the above direction, the Civil Revision Petition is disposed of.
