THE HONOURABLE SRI JUSTICE K.LAKSHMAN W.P.No. 1776 of 2020 ORDER:

Heard learned counsel for the petitioner and Government Pleader for Revenue.

The petitioner is claiming that he is in possession of the land admeasuring Ac.2.12 gts in Survey No.226 of Hasnapur Village, Utnoor Mandal, Adilabad District.

According to the petitioner, he has submitted representation on 15.05.2018 to the 2nd respondent-District Collector with a request to issue pattadar pass-book in his favour by considering the long possession over the subject property. The petitioner stated that the 2nd respondent directed the 3rd respondent to conduct enquiry and pass appropriate orders on the said representation dated 15.05.2018 and pursuant to the same, the 3rd respondent - Revenue Divisional Officer issued notice dated 24.12.2018 fixing hearing date as 05.01.2019 at 03.00 PM. The petitioner also stated that the 6th respondent has attended the said hearing and the 3rd respondent informed them that further date would be intimated.

Learned counsel for the petitioner contended that the petitioner is waiting for the intimation from the 3rd respondent with regard to the next date of hearing, without concluding the said enquiry by the 3rd respondent, 4th and 5th

respondents are coming to the subject property and trying to dispossess the petitioner.

On the other hand, learned Government Pleader for Revenue would submit that the petitioner is not the owner of the property and he is not entitled for any relief as sought for. The proceedings dated 13.07.2018 issued by the 4th respondent shows that the petitioner is in possession of the subject property. Admittedly, the enquiry with regard to the issuance of pattadar pass-book is pending with the 3rd respondent and the same is evident from the notice No.H/484/2018, dated 24.12.2018. In view of the same, the 3rd respondent-RDO is directed to conclude the enquiry and pass appropriate orders within two months from the date of receipt of a copy of this order and furnish copy of the same to the petitioner. Till such enquiry is concluded, respondents 1 to 5 are directed not to dispossess the petitioner from the subject property.

In view of the above, the writ petition is disposed of. There shall be no order as to costs.
