THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.4273 of 2014 ORDER:

This writ petition is filed by the petitioner, under Article 226 of the Constitution of India, seeking to declare the action of the 2nd respondent in proposing Lift Irrigation Scheme on Penna river in Kamalapuram Mandal of Kadapa District by issuing Tender Notice No.86/2013-14, dated 23.01.2014 (construction and commissioning on turnkey basis of Kokatam Lift Irrigation Scheme) as illegal and arbitrary and consequently set aside the said notification.

Heard and perused the material available on record. 3.

Learned counsel for the petitioner submitted that the tender process is already over and the construction is likely to be completed.

Having regard to the said submission and on perusal of the record, this Court is of the view that nothing survives in this writ petition for adjudication and the writ petition is liable to be dismissed as infructuous.
