THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.632 of 2017 ORDER:

Heard learned counsel for petitioner and Assistant Government Pleader for Agriculture.

Petitioner challenges Proceedings Roc.No.DAO/ SEEDS/ 2016-17 dated 21-11-2016 suspending the licence of petitioner for 90 days as illegal, arbitrary and without jurisdiction.

Learned counsel for petitioner challenges the suspension order on several factual and legal grounds.

Having regard to the stage of consideration of issue by 2nd respondent, I am not proposing to examine the merits of the contentions urged by petitioner. I am satisfied particularly having regard to the explanation dated 26-10-2016 given by petitioner, the 2nd respondent can be directed to examine the representation and pass necessary orders as are deemed fit and proper both on request of petitioner and also necessity to continue the order of suspension. The said exercise shall be carried out within two weeks from the date of receipt of a copy of this order. The petitioner is given liberty to communicate the copy of this order within one week from today.

The writ petition is disposed of accordingly. As a sequel, the miscellaneous applications, if any pending, shall stand closed. There shall be no order as to costs.
