The case of the petitioner is that the 3rd respondent issued show cause notice dated 02.11.2016 to the petitioner asking the petitioner as to why disciplinary action should not be taken against him.
Thereafter, the petitioner submitted explanation on 09.11.2016. But the respondents neither passed any orders in pursuance to the show cause notice nor reinstated the petitioner into service. Aggrieved by the same, present writ petition is filed. Heard learned counsel for the petitioner and learned Assistant Government Pleader for Home.
Since the petitioner has submitted explanation in pursuance to the show cause notice it is for the 3rd respondent either to drop further proceedings if he satisfies with the said explanation or to take further action. He cannot keep the matter pending. In view of the same, the 3rd respondent is directed to consider the explanation dated 09.11.2016 submitted by the petitioner and take action in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.
Accordingly, the writ petition is disposed of. No order as to costs.
As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
