THE HON'BLE SRI JUSTICE P.NAVEEN RAO CONTEMPT CASE No. 142 of 2019 ORDER :
This Contempt Case is filed alleging violation of the order dt.23.08.2018, passed by this Court in WP.No.29402 of 2018, wherein the petitioner was granted liberty to make a representation to the Deputy Commissioner of Labour, Adilabad, ventilating his grievance and desire to be promoted as Junior Assistant and also the Deputy Commissioner was directed to consider the said representation having regard to the cyclic point available to the post of Office Subordinates, eligibility and seniority of the petitioner.
Heard learned counsel for the petitioner.
Learned Government Pleader for the respondent produced letter dated 13.11.2018 of the Joint Commissioner of Labour addressed to the Commissioner of Labour, wherein the Commissioner of Labour was informed that as of now there is no vacancy in cyclic point and he would consider the application of the petitioner as and when the cyclic point and Rule of Reservation point to the Schedule Tribes arises. It is also stated that the petitioner is junior.
Learned Counsel for the petitioner sought to dispute the said submission and contends that the persons who are juniors to the petitioner were already promoted.
However, no material is placed on record to show that even though the petitioner was sufficiently senior and eligible for promotion, he was ignored for promotion.
In view of the letter produced by the learned Government Pleader for the respondent, it cannot be said that the respondent deliberately violated the order of this Court.
Accordingly, the Contempt Case is closed granting liberty to the petitioner to agitate on the issue of ignoring him for promotion while granting the promotion to his juniors. No order as to costs. As a sequel to the disposal of the Contempt Case, miscellaneous applications, if any, pending shall stand closed. ___________________ P.NAVEEN RAO, J 30.04.2019 tk
