HONOURABLE SRI JUSTICE P.NAVEEN RAO ORDER:

Petitioners are close relatives of Mohd.Avez Ahmed @ Ahamed, son of Md.Yousuf (1st petitioner). Petitioners allege that on the ground that certain crimes are registered against Mohd. Avez Ahmed, the Police are harassing the petitioners though they are no way concerned with the alleged crimes. Petitioners also sought to contend that Police raided their houses and took away the gold ornaments and cash belonging to family members. Petitioners allege that as they are no way concerned with the alleged crimes registered against Mohd.Avez Ahmed, there is no justification to harass the petitioners, raid their houses and cause unnecessary interference into their personal life. 2.

On instructions, learned Government Pleader, would submit that several crimes were registered against Mohd.Avez Ahmed and recently also Crime No.11 of 2019 was registered in Chadarghat Police Station. As consequent to the registration of crime, for the purpose of investigation, Police have visited the houses where they suspected that Mohd.Avez Ahmad was residing.

Learned Government Pleader would submit that Police have visited the respective houses of petitioners only to ascertain the whereabouts of Mohd.Avez Ahmad, but not otherwise. Learned Government Pleader denies the allegation of taking away the gold ornaments and cash from the petitioners.

This Court is not inclined to go into the issue of whether Police have taken away the gold ornaments and cash as sought to

be contended and it is for the petitioners to work out their remedy on this aspect.

The limited issue for consideration is whether Police can interfere with the private life of petitioners without registering the crime.

Apparently, no crime is registered against petitioners. They are close relatives of Mohd.Avez Ahmad and crimes are registered against Mohd.Avez Ahmad. That being so, Police are directed not to interfere with the personal life and liberty of petitioners', unless crime is registered against them. Police also shall not raid the houses of petitioners without following due procedure. However, petitioners also shall cooperative with the Police to elicit any information in the crimes registered against Mohd.Avez Ahmad. Writ Petition is accordingly disposed of. Pending miscellaneous petitions shall stand dismissed.
